A G R E E MEN T
AGREEMENT by and between the CITY OF CLERMONT, a municipal corporation
existing under the laws of the State of Florida, hereinafter referred to as CITY;
and POYNTER-HARDER CONSTRUCTION COMPANY, INC., a Florida corporation, hereinafter
referred to as POYNTER-HARDER; and CLERMONT EMERALD LAKES, INC., a Florida
corporation, hereinafter referred to as EMERALD LAKES.
WHEREAS, the CITY has determined that it is in the best interests of the
CITY OF CLERMONT to extend Broome Street according to the Official Map of the
CITY OF CLERMONT from the west right-of-way line of Twelfth Street westerly to
Emerald ~akes Mobile Home Village, and
WHEREAS, the CITY, POYNTER-HARDER and EMERALD LAKES have agreed to share
the costs and expenses of the construction of the extension of Broome Street in
accordance with the following conditions.
NOW, THEREFORE, the parties agree:
1. The CITY will extend Broome Street according to the Official Map of
the CITY OF CLERMONT from the westerly right-of-way of Twelfth Street westerly
to Emerald Lakes Mobile Home Village.
2. The CITY agrees to construct the extension including, but not limited
to, obtaining all necessary engineering specifications, construction contract
documents and the actual construction and all other matters necessary to construct
the extension. The CITY retains complete control and authority to construct the
extension in accordance with its established policies.
3. The parties agree to share all costs of constructing the extension in
the following manner:
1/3 - CITY OF CLERMONT
1/3 - POYNTER-HARDER CONSTRUCTION COMPANY, INC.
1/3 - CLERMONT EMERALD LAKES, INC.
4. The CITY will bill POYNTER-HARDER and EMERALD LAKES in accordance with a
billing procedure established by the CITY and POYNTER-HARDER and EMERALD LAKES agree
to pay same promptly. Any breach hereof may be enforced by any appropriate legal
action and the parties hereto agree to pay all costs of collection or enforcement of
this agreement, including a reasonable attorney's fee.
5. The CITY agrees to accept the extension as a public right-of-way and will
assume appropriate maintenance of same.
