R-00-1160~' ~ • • CITY OF CLERMONT RESOLUTION NO. 1160 A RESOLUTION OF THE CITY OF CLERMONT, LAKE COUNTY, FLORIDA, ESTABLISHING THE RATE SCHEDULE FOR STORMWATER SERVICE, REPEALING RESOLUTION NO. 689 AND PROVIDING FOR AN EFFECTIVE DATE WHEREAS, it is hereby found and determined by the City Council of the City of Clermont, Lake County, Florida, that the rate schedule for stormwater service shall be amended as follows: A stormwater fee of $5.00 per month shall be charged for each residence. This shall include each single family home, each duplex or multiple units, each mobile home or any other dwelling unit. 2. Non-residential properties shall be charged a monthly stormwater fee based on the rate established in Paragraph 1 ($5.00) multiplied by the number of Equivalent Residential Units (ERU's) assigned to the property. In the case ofnon-residential multiple unit properties on separate meters, the calculated charge for the entire property shall be pro-rated and billed to each unit according to the square footage of that unit as a percentage of the total property. 3. An Equivalent Residential Unit (ERU) equals the average impervious area of a residential unit and is hereby established as 3,154 square feet. 4. Non-residential properties shall be assigned ERU's calculated by dividing the total impervious area of the property by the ERU established in Paragraph 3. ERU's shall be rounded to the nearest one-tenth (0.1) of a unit. 5. A credit equal to forty percent (40%) of the calculated fee will be given for on-site stormwater retention if the property has a properly maintained water retention area that has been engineered by a Florida Registered Professional Engineer and meets or exceeds the requirements of the City of Clermont Stormwater Code. In no case shall the fee be less than $3.00 per month per unit. 6. Billing shall be on a monthly basis and shall be included in the city utility bill for other services. In the event a property is vacant, that is, where a tenant or owner has vacated the building and discontinued other city services, the property owner shall continue to be charged the stormwater utility fee. Multi-units with a single meter shall be billed to the holder of the utility account. 7. Public rights-of--way and municipally owned and operated facilities are exempt from all stormwater fees.
