RESOLUTION NO. 1106 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CLERMONT, LAKE COUNTY, FLORIDA, GRANTING A CONDITIONAL USE PERMIT TO AMEND RESOLUTION N0.952 TO ALLOW THE EXPANSION OF RETAIL, PROFESSIONAL OFFICE AND RESTAURANT USES WITHIN THE EXISTING STRUCTURES, LOCATED IN THE CBD CENTRAL BUSINESS DISTRICT. WHEREAS, the Planning and Zoning Commission of the City of Clermont, Lake County, Florida at a meeting held January 4, 2000 recommended approval of this Conditional Use Permit to amend Resolution No. 952 to allow the expansion of retail, professional office and restaurant uses within the existing structures located in the CBD Central Business District. LOCATION 915 West Montrose Street, The Mulberry Inn The City Council deems it advisable in the interest of the general welfare of the City of Clermont, Lake County, Florida to grant this Conditional Use Permit; • NOW THEREFORE BE IT RESOLVED by the City Council of the City of Clermont, Lake County, Florida that: SECTION 1. This application for a Conditional Use Permit to amend Resolution No. 952 to allow the expansion of retail, professional office and restaurant used within the existing structures located in the CBD Central Business District. 1. B&B bedrooms will be decreased from 5 to 4; retaiUoffice uses in the main house will be increased from 150 s.f, to 800 s.f.. 800 s.f. of residential space in building #4 will be converted to retail/office use; 1 Bed and Breakfast bedroom in Building #4 will be converted to 200 s.f of retail/office space; and 300 s.f. of Building #3 shall be converted to restaurant use. For a total of 4 B&B bedrooms, 2192 s.f. of retaiUoffice space and 447 s.f. of restaurant space. The permitee shall make provision for 15 parking spaces as required by Code. 2. The conditions as set forth in this Conditional Use Permit shall be legally binding upon any heirs, assigns and successors in title or interest. 3. No further expansion of the use or additions to the facility shall be permitted except as approved by another Conditional Use Permit. • • • r~ LJ cry o~ cc~~~toa~7 RESOLUTION NO. 1106 Page - 2 - 4. The property shall be developed in substantial accordance with a site plan approved by the City incorporating all conditions of this Conditional Use Permit. The final Certificate of Occupancy shall not be issued until each of the stated conditions has been met. 6. If any of the stated conditions are violated, the applicant understands and agrees that the City Council may revoke this Conditional Use Permit by resolution. 7. The Conditional Use Permit must be executed and filed in the office of the City Clerk within 90 days of its date of grant by the City Council or the permit shall become null and void. 8. This permit shall become null and void if the new uses have not begun operation within one (1) year from the date of execution of the Conditional Use Permit by the applicant.
