R-99-1098• CITY OF CLERMONT RESOLUTION NO. 1098 r~ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CLERMONT, LAKE COUNTY, FLORIDA, AMENDING THE PENSION PLAN OF THE CITY OF CLERMONT AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, by Ordinance 195 adopted the 20`" day of December, 1960, the City Council of the City of Clermont, Florida established a Pension Plan for full-time, permanent employees of the City of Clermont, Florida; and WHEREAS, Part II, Chapter 46, Section 46-61 of the Clermont Code of Ordinances states the general supervision of the administration of the Clermont Pension Plan shall be by a seven- member Board consisting of the City Council and one representative each for the Clermont Police Department and the Clermont Fire Department; and WHEREAS, recent changes to Chapters 175.351 and 185.35, Florida Statutes requires police • officers and firefighters to hold an election to determine if their Plans should be administered by one Board consisting of police officers and firefighters or separate Boards for police officers and firefighters; and WHEREAS, the police officers and firefighters held an election to decide such issue and elected to have separate Boards of Trustees to administer the police officers and firefighters Plans; NOW, THEREFORE, be it resolved by the City of Clermont, Lake County, Florida, that: Section 1. In accordance with Chapter 185.05, Florida Statutes, the Clermont Pension Plan as it pertains to police officers' issues shall be administered by the Clermont Police Officers' Pension Board of Trustees. The membership of the Board shall consist of five (5) members, two (2) of whom shall be legal residents of the City, who shall be appointed by the City Council, and two • .. • • CITY OF CLERMONT RESOLUTION • NO. 1098 (2) of whom shall be elected by a majority of the police officers who are members of such Plan. The fifth (5`h) member shall be chosen by a majority of the other four (4) Board members, and such person's name shall be submitted to the City Council for appointment as the fifth (5`'') member. Section 2. In accordance with Chapter 175.061, Florida Statutes, the Clermont Pension Plan as it pertains to firefighters' issues shall be administered by the Clermont Firefighters' Pension Board of Trustees. The membership of the Board shall consist of five (5) members, two (2) of whom shall be legal residents of the City, who shall be appointed by the City Council, and two (2) of whom shall be firefighters who shall be elected by a majority of the firefighters who are members of such Plan. The fifth (5"') member shall be chosen by a majority of the other four (4) Board members, and such person's name shall be submitted to the City Council for appointment as the fifth (5`h) member. • Section 3. The Clermont Pension Plan as it pertains to general employees' issues shall be administered by the City Council. Section 4. This Resolution shall take effect October 1, 1999.
