construct drainage for Sunnyside Drive, Pine Lane, Chestnut Street and West Avenue.

Design of stormwater collection/transmission system to modify the existing system as to
eliminate or minimize localized flooding or ponding areas. Design shall meet or exceed the

TASK II PINE LANE

TASK V PERMITTING
Attend DRS meeting(s), answer request for additional information letter(s), applications,
calculations, etc.
Prepare submittal package to the City of Clermont to include plans and calculations
for inlet and storm pipe designs. Attend City of Clermont staff meetings as required.
FEE $ 1,500.00
TASK VI PROJECT ADMINISTRATION
The scope of services shall include administrative services necessary to coordinate all
aspects of the project through the planning, design and permitting phase. These services
shall include project scheduling with all regulatory agencies and public utility companies
during the design and permitting phase of the project.
FEE $ 2,000.00
TASK VII CONSTRUCTION ADMINISTRATION
All necessary inspections, final certifications and as-builts as required by permit conditions
which consist of the following:
Booth, Ern, Straughan & Hiott, Inc. shall prepare Industry Standard bid documents
and specifications to bid all four (4) projects as one job. Conduct mandatory pre-
bid meeting, receive bids, prepare spreadsheet of bids for comparison and make
recommendation of winning bid and time of construction.

2. Booth, Ern, Straughan & Hiott, Inc., will advise and consult with Owner throughout
the duration of construction. Booth, Ern, Straughan & Hiott, Inc., will make periodic
visits to the site to observe the progress and quality of the executed site work and
to determine in general if the work is proceeding in accordance with the construction
drawings and specifications. Booth, Ern, Straughan & Hiott, Inc., wiN review and
approve shop drawings, results of tests and inspections and other data that the
contractor is required to submit.
Based upon the on-site observations and as-built survey data provided by the
contractor, Booth, Ern, Straughan & Hiott, Inc. shall prepare and submit as-built
construction drawings and certifications of completions to the owner and the
following State and local agencies as required:
A. City of Clermont

TASK 999 REiMBURSABLES
Reimbursables to be billed based upon direct expense incurred by Booth, Ern, Straughan,
& Hiott, Inc., blueprints, copies, mylars, reproductions, postage, etc.

I. GENERAL CONDITIONS
A. TERMINATION:
The agreement may be terminated by either party upon thirty (30) days written
notice.
B. REQUEST FOR SERVICE:
Any request to replace or repair existing work such as survey control points shall be
complied within a reasonable time period.
C. DOCUMENTS:
All original drawings, computations, details, design calculations, and electronic
media that result from Booth, Ern, Straughan & Hiott, Inc., services are the property
of Booth, Ern, Straughan & Hiott, Inc. Upon payment in full for services completed,
client may at his expense, obtain copies of any documents or reproducible copies
of drawings. In doing so, client agrees that no additions, deletions, changes or
revisions shall be made to same without the express written approval of Booth, Ern,
Straughan & Hiott, Inc.
SURVEY DOCUMENTS
All original drawings, computations, details, design calculations, and electronic
media that result from Booth, Ern, Straughan & Hiott, Inc., services are the property
of Booth, Ern, Straughan & Hiott, Inc. Signed sealed surveys may be obtained up
to 90 days after issuance of survey and certifications may be revised during that
time period for a fee of $50.00. Upon payment in full for services completed, client
may at his expense, obtain copies of any documents or reproducible copies of
drawings, within the 90 day period. In doing so, client agrees that no additions,
deletions, changes or revisions shall be made to same without the express written
approval of Booth, Ern, Straughan & Hiott, Inc. Booth, Ern, Straughan & Hiott, Inc.,
will revise certifications and visually inspect subject property, to reissue a signed
and sealed survey, within 180 days of issuance of original survey, at an hourly rate.
After 180 days an updated survey must be performed
D. FEE RENEGOTIATION:
The hourly rates given in this contract for additional services requested by the
client outside the scope of the contract tasks are applicable through December 31 S,
of the year the contract was executed, and are subject to renegotiation on January
1, each year, thereafter. Contract prices shall remain as quoted for two (2) years
after execution of contract after which, contract prices shall be renegotiated for any
remaining tasks.

E. REGULATORY REQUIREMENTS:
The fees quoted herein are quoted based on alt regulations, state and or local that
are presently in effect as of this date. If regulations change during the permitting
and design phase of this project, Booth, Ern, Straughan & Hiott, Inc., reserves the
right to renegotiate fees for services that may be affected by regulatory changes.
F. PERMIT ACQUISITION
Booth, Ern, Straughan & Hiott, Inc., cannot guarantee the acquisition of all
permits/approvals. However, we will strive toward this end. Client is responsible
for payment of all consulting fees due Booth, Ern, Straughan & Hiott, Inc.,
regardless of agency/governmental actions.
COMPENSATION
A. ADDITIONAL SERVICES:
Booth, Ern, Straughan & Hiott, Inc., will be compensated for additional services,
such as:
Changes in scope of services defined in this contract at the client's request.
2. Revisions caused by changes of governmental requirements after the date
of this agreement.
3. Redesign per client after preliminary design has been submitted to the
approving agency.
B. OUT-OF-POCKET EXPENSES:
In addition to the fee schedule and any additional services, Booth, Ern, Straughan
& Hiott, Inc., shall be reimbursed for out-of-pocket expenses for actual cost, such
as: blueprints, copies, plots, aerials, express deliveries, specialized postage,
Federal Express, UPS, etc. and travel outside of the Central Florida area (greater
than 25 miles from the Tavares office)
C. ACCEPTANCE:
Billing shall be sent on asemi-monthly (twice per month) basis and each shall
reflect the percentage of work completed during the billing period. Alf invoices shall
be paid within fourteen (14) days. All unpaid balances after fourteen (14) days shall
be subject to a finance charge of 1.5% interest. Booth, Ern, Straughan & Hiott, Inc.,
reserves the right to withhold submittal of applications until such time that all unpaid
balances have been satisfied. The undersigned will pay all costs and expenses,

including a reasonable attorney's fee, incurred or paid by Booth, Ern, Straughan &
Hiott, Inc., in the collection of this obligation by suit or otherwise. Booth, Ern,
Straughan 8~ Hiott, Inc., reserves the right to stop work on the above agreed scope
of services if any invoice remains unpaid in its entirety for more than 60 days.
Any and all outstanding balances shall be paid or brought current before submittal
of Final Improvement Drawings and or Final Plat for approval by state and local
agencies.
