R-99-1071• • CITY OF CLERMONT RESOLUTION NO. 1071 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CLERMONT, LAKE COUNTY, FLORIDA, GRANTING A CONDITIONAL USE PERMIT TO ALLOW THE CONSTRUCTION OF A MEDICAL OFFICE/CLINIC AND AMBULATORY SURGICAL CENTER TO INCLUDE DOCTORS OFFICES AND OTHER PROFESSIONAL OFFICES, LOCATED IN THE C-2 GENERAL COMMERCIAL BUSINESS DISTRICT. WHEREAS, the Planning and Zoning Commission of the City of Clermont, Lake County, Florida at a meeting held June 1, 1999 recommended approval of this Conditional Use Permit to allow the construction of a medical office/clinic and ambulatory surgical center to include doctors offices and other professional offices located in the C-Z General Commercial Business District at the following location: LEGAL DESCRIPTION Lot 7, Citrus Tower Centre The City Council deems it advisable in the interest of the general welfare of the City of Clermont, Lake County, Florida to grant this Conditional Use Permit; NOW THEREFORE BE IT RESOLVED by the City Council of the City of Clermont, Lake County, Florida that: SECTION 1. This application for a Conditional Use Permit to allow the construction of a medical office/clinic and ambulatory surgical center to include doctors offices and other professional offices located in the C-2 General Commercial Business District be granted subject to the following conditions: 1. The conditions as set forth in this Conditional Use Permit shall be legally binding upon any heirs, assigns and/or successors in title or interest. 2. The property shall be developed in substantial accordance with an approved site plan incorporating all conditions of this Conditional Use Permit. Said plans shall be submitted for review and approval of the Site Review Committee prior to authorization and issuance of a development permit. • • CITY OF CLERMONT RESOLUTION NO. 1071 Page-2- 3. The permittee shall provide a sidewalk constructed in accordance with City standards along Grand Highway (Citrus Tower Blvd.) length of the subject property. 4. The permittee shall dedicate right-of-way along the length of the subject property as to create 40 feet of right-of-way from the centerline of the right-of-way of Grand Highway (Citrus Tower Boulevard). 5. The permittee shall provide a cross access driveway to the property adjacent to the west. 6. Permittee shall pay for the inclusion of a west bound turn lane on Citrus Tower Boulevard at the time Lake County rebuilds the intersection and the roadway along the frontage of the permittees property. 7. Landscaping for Phase II of the project shall be in conformance with the Land • Development Regulations as adopted at the time of site review of Phase II. 8. No further expansion of the use or additions to the facility shall be permitted except as approved by another Conditional Use Permit. 9. This permit shall become null and void if substantial construction work has not begun within one (1) year of the date of issuance of this Conditional Use Permit. "Substantial construction work" means the commencement and continuous Prosecution of construction of required improvements ultimately finalized at completion. 10. The final Certificate of Occupancy shall not be issued until each of the stated conditions has been met. 11.
