This application for a Conditional Use Permit to a ow the co traction of a convenience store/gas station, car wash and restaurant, located in he C- eneral Commercial Business District be granted subject to the following condition 1. This Conditional Use Permit shall inure to th e fit of, and shall constitute a covenant running with the land and the terms, conditions, an provis ns hereof, and shall be binding upon the present owner, heirs, and any successor(s) in tle or inte st, and shall be subject to each and every condition herein set out. 2. The property may be used as a conv nience store/gas statio car wash, and restaurant only. No change of the use or additions tot use shall be permitted e ept as approved by another Conditional Use Permit. 3. No person, firm, corporati or entity shall erect, construct, enlar ,alter, repair, remove, improve, move, convert, or dem ish any building or structure, or alter the nd in any manner without first submitting necess ry plans, obtaining necessary approvals, and btaining necessary permits in accordance with ~ City of Clermont Land Development Regulatio sand City Code of Ordinances. • • Clri~'O~ CL~R,M091~? Prior to the issuance of any permits, the applicant shall be required to submit formal site plans for review and approval by the City of Clermont Site Review Committee. The site plans shall meet all submittal requirements and comply with the conditions of this Conditional Use Permit, applicable City Codes, Regulations, Ordinances, and provide compliance with the adopted City Comprehensive Plan, as amended. ',-~ 5. A parking, traffic circulation, and ingress/egress plan shall be submitted and approved by the City Site Review Committee prior to any development activity on the site. 6. Roadway improvement plans for State Road 50, Grand Highway, and the commercial site, including but not limited to, access drives, acceUdecel lanes, turn lanes, traffic signalization devices, and internal signage and traffic movement lanes shall be submitted to and approved by the City Site Review Committee, FDOT and Lake County prior to commencement of any development activity. 7. Prior to the construction and development of the project, the permittee/developer shall provide a traffic analysis which identifies the development's impact on the City's transportation system. 8. Ingress to the site from SR 50 shall utilize aright-in movement only, and shall be constructed with a decel lane as approved by the FDOT and the City. 9. The permittee agrees to dedicate ten (10) feet of right-of--way the length of the site adjacent to Grand Highway for conformance with adopted collector roadway standards. Said dedication shall be provided and recorded prior to any development activity on the site. 10. The permittee/developer shall construct a northbound right turn lane on Grand Highway at the intersection of S.R. 50. 11. Sidewalks shall be constructed along Grand Highway and S.R. 50 in accordance with FDOT and City Codes. 12. The permit shall expire if construction has not begun within one year from the date of grant of this Conditional Use Permit. • • • ~. CI`17'O~ CL~"M09~7 RESOLUTION NO. 1065 Page - 3 - 13. If any of the stated conditions are violated, the applicant understands and agrees that the City Council may revoke this Conditional Use Permit by resolution.
