R-99-1064 • cry o~ cL~~a~toa~~ RESOLUTION NO. 1064 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CLERMONT, LAKE COUNTY, FLORIDA, GRANTING A CONDITIONAL USE PERMIT TO ALLOW THE OPERATION OF A CHURCH AND CHRISTIAN SCHOOL WITH TEMPORARY GRASS PARKING, LOCATED IN THE C-2 GENERAL COMMERCIAL BUSINESS DISTRICT. WHEREAS, the Planning and Zoning Commission of the City of Clermont, Lake County, Florida at a meeting held May 4, 1999 recommended approval of this Conditional Use Permit to allow the operation of a Church and Christian School located in the C-2 General Commercial Business District at the following location: LOCATION 100 Grand Highway • The City Council deems it advisable in the interest of the general welfare of the City of Clermont, Lake County, Florida to grant this Conditional Use Permit; NOW THEREFORE BE IT RESOLVED by the City Council of the City of Clermont, Lake County, Florida that: SECTION 1. This application for a Conditional Use Permit to allow the operation of a Church and Christian School located in the C-2 General Commercial Business District be granted subject to the following conditions: 1. This Conditional Use Permit shall inure to the benefit of, and shall constitute a covenant running with the land and the terms, conditions, and provisions hereof, and shall be binding upon the present owner, heirs, and any successor(s) in title or interest, and shall be subject to each and every condition herein set out. 2. Upon approval of the Conditional Use Permit the aforementioned property shall only be used for the purposes described herein. Any other proposed use shall be specifically authorized by amendment of the Conditional Use Permit and approval of the City of Clermont City Council. • • • r1 U CI~Z~' O~ CL~~,M0~7 RESOLUTION NO. 1064 Page - 2 - 3. No person, firm, corporation or entity shall erect, construct, enlarge, alter, repair, remove, improve, move, convert, or demolish any building or structure, or alter the land in any manner without first submitting necessary plans, obtaining necessary approvals, and obtaining necessary permits in accordance with the City of Clermont Land Development Regulations and City Code of Ordinances. 4. Prior to the issuance of any permits, the applicant shall be required to submit formal site plans for review and approval by the City of Clermont Site Review Committee. The site plans shall meet all submittal requirements and comply with the conditions of this Conditional Use Permit, applicable City Codes, Regulations, Ordinances, and provide compliance with the adopted City Comprehensive Plan, as amended. 5. A parking, traffic circulation and ingress/egress plan shall be submitted and approved by the City Site Review Committee prior to any development activity on the site. Said traffic • circulation plan shall indicate closure of the existing north driveway and the south driveway into the parsonage. Upon completion of roadway improvements to the intersection of Grand Highway and Mohawk Road, a single driveway shall be constructed as approved by the City and Lake County. 6. Grass parking shall be allowed on a temporary basis until the programmed improvements to the intersection of Grand Highway and Mohawk Rd. are completed. Parking must be constructed according to City code within six (6) months after the completion of the aforementioned roadway improvements. 7. The permittee shall provide sidewalks constructed in accordance with City and ADA standards along Grand Highway and Mohawk Road at the time the parking lot is constructed. The permittee will only be required to construct sidewalk where the subject property abuts the road right-of-way. 8. The permittee shall dedicate right-of-way along the length of the subject property as to create 40' of right-of-way from the centerline of the rights-of-way for Mohawk Road and Grand Highway. 9. The permittee shall connect to the City's sewer system at such time sewer service is available. • • • • C77}'O~ CL~RM0~7 RESOLUTION NO. 1064 Page - 3 - 10. The permittee shall be allowed to rent/lease the parsonage for single family residential purposes until such time as it is needed for the school. 11. The church and school shall be permitted to continue utilization of curbside pick-up service until such time as determination is provided by the City Public Services Director that commercial dumpster service is required. At that time the permittee shall provide the site with a masonry dumpster enclosure with wooden gates, constructed in accordance with City Standards. 12. The final Certificate of Occupancy shall not be issued until each of the stated conditions has been met. 13. If any of the stated conditions are violated, the applicant understands and agrees that the City Council may revoke this Conditional Use Permit by resolution. . 14. The permit shall expire if construction has not begun within one year from the date of grant of this Conditional Use Permit.
