R-99-1063• • CITY OF CLERMONT RESOLUTION • NO. 1063 A RESOLUTION OF THE CITY OF CLERMONT, LAKE COUNTY, FLORIDA, AMENDING THE PERSONNEL POLICY OF THE CITY OF CLERMONT AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Clermont adopted the current Personnel Policy of the City of Clermont Resolution No. 705 dated February 26, 1991, and amended it by Resolution 739 dated October 8, 1991, Resolution No. 746 dated July, 28, 1992 and Resolution No. 771 dated September 24, 1992 and Resolution No. 923 dated September 24, 1996 and Resolution No. 1041, dated November 24, 1998; and NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Clermont that the City of Clermont Personnel Policy will be amended as follows: Section 1 Chapter 2, Section 4.035 shall be added to read as follows: 4.035 Pre-Employment Physical Ability Test: As a condition of obtaining a position • with the City as a firefighter, all individuals must successfully complete a physical ability test. The purpose of the test is to assure that individuals are physically capable of performing the rigorous and strenuous tasks required of firefighters on the scene of a structure fire, building collapse or other emergency in order to adequately protect lives and property. Section 2 Chapter 5, Section 3 shall be deleted and replaced to read as follows: Section 3. Annual Physical Examination: 3.010 Firefighters As a condition of maintaining a position with the City as a firefighter, all individuals must receive medical clearance on an annual basis from the City's designated physical examination provider by December 31 of each year. The physical examination shall be performed in accordance with guidelines outlined by the National Fire Protection Association (NFPA). In the event that the City's designated physical examination provider does not provide medical clearance for the individual to perform firefighting duties the firefighter shall be terminated. • The cost of the annual physical examination shall by paid by the City. • ~ Full-time firefighters will be permitted leave with pay up to two (2) hours and volunteer firefighters shall be paid at a rate of one (1) drill for the time necessary to take the physical examination. 3.020 Other Emalovees As a condition of employment with the City as a full-time employee, all individuals must receive an annual physical examination by December 31 of each year. The physical examination shall include specific tests as approved by the City Council. In the event, an employee refuses to have an annual physical examination, the employee shall be terminated. The physical examination may be administered by the City's designated physical examination provider or by the employee's private physician. If the physical examination is performed by the employee's private physician, the physician must certify to the City that the same tests as performed by the City's designated physical examination provider were performed. The cost of the annual physical performed by the City's designated physical examination provider shall be paid by the City. The City will reimburse the employee for the cost of the private physician examination up to the current price charged by the City's designated examination provider. Employees will be permitted leave with pay up to two (2) hours, upon the • approval of their department head to take the annual physical examination. The results of the annual physical examination will not be made available to the City. The exam results are strictly confidential between the employee and the physician. Section 3 Chapter 6, Section 15 shall be added to read as follows: Section 15. Annual Physical Ability Test As a condition of maintaining a position with the City as a firefighter, all individuals must successfully complete a physical ability test on an annual basis by December 31 of each year. The purpose of the test is to assure that individuals are physically capable of performing the rigorous and strenuous tasks required of firefighters on the scene of a structure fire, building collapse or other emergency in order to adequately protect lives and property. In the event that the firefighter fails the annual test, the firefighter will be allowed to retake the test three (3) times in the following six (6) month period. If the firefighter can not successfully complete the test in this time frame, the firefighter shall be terminated. • • • Section 4 This resolution shall become effective immediately upon adoption.
