R-99-1058• cz~y o~ cL~R~toa~7 RESOLUTION NO. 1058 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CLERMONT, LAKE COUNTY, FLORIDA, GRANTING A CONDITIONAL USE PERMIT TO AMEND RESOLUTION N0.772 TO ALLOW THE EXPANSION OF AN EXISTING CHILD CARE CENTER, LOCATED IN THE C-1 LIGHT COMMERCIAL DISTRICT. WHEREAS, the Planning and Zoning Commission of the City of Clermont, Lake County, Florida at a meeting held Apri16, 1999 recommended approval of this Conditional Use Permit to amend Resolution No. 772 to allow the expansion of an existing child care center, located in the G1 Light Commercial District at the following location: LOCATION 191 West Broome Street The City Council deems it advisable in the interest of the general welfare of the City of Clermont, Lake County, Florida to grant this Conditional Use Permit; NOW THEREFORE BE IT RESOLVED by the City Council of the City of Clermont, Lake County, Florida that: SECTION 1. This application for a Conditional Use Permit to amend Resolution No. 772 to allow the expansion of an existing child care center, located in the C-1 Light Commercial District, be granted subject to the following conditions: 1. This Resolution shall inure to the benefit of, and shall constitute a covenant running with the land and the terms, conditions, and provisions hereof, and shall be binding upon the present owner/permittee and any successor in title or interest, and shall be subject to each and every condition herein set out. 2. Upon approval of this resolution the aforementioned property shall only be used for a day care/pre-school facility. Any other proposed use shall be specifically authorized by amendment and approval of the City of Clermont City Council. • • • • CI'Ir}'O~" CL~~~f09~? RESOLUTION NO. 1058 Page - 2 - 3. Construction and operation of the proposed use shall at all times comply with the regulations of this and other governmental departments and agencies. All of the requirements of other regulatory agencies concerning new construction and renovation of a day care and/ or pre- school facilities shall be met. All required improvements must be completed prior to issuance of a Certificate of Occupancy for the requested use. 4. No person, firm, corporation or entity shall erect, construct, enlarge, alter, repair, remove, improve, move, convert, or demolish any building or structure, or alter the land in any manner within the boundary of the property without first submitting necessary site and building plans, obtaining necessary approvals, and obtaining necessary permits in accordance with the City of Clermont Land Development Regulations and City Code of Ordinances. 5. Any improvements required for the new construction and renovation of the existing . structure required by the Fire Marshall shall be met prior to issuance of a Certificate of Occupancy. 6. Prior to receipt of a Certificate of Occupancy for the new additions and improvements a five (5) feet wide standard City sidewalk shall be constructed by the applicant along both Second Street and Broome Street the length of the subject property. 7. A minimum of 11 parking spaces shall be provided, eight (8) spaces shall be paved while the remaining spaces may be mulch or grass. All parking spaces shall be constructed in conformance with City regulations. 8. The existing walkway on the north side of the property, extending from the structure to Broome Street shall be removed. 9. The existing driveway located on Second Street shall be totally eliminated and finished FDOT type "F" curb shall be constructed along the roadway. All areas disturbed by the driveway removal shall be sodded, landscaped and irrigated in conformance with adopted City Code. 10. Buffering and screening from abutting properties, and Second and Broome Streets shall be required in accordance with adopted City Codes and in conformance with an approved site and landscaping plan. 12. If any of the stated conditions are violated, the applicant understands and agrees the City Council may revoke this Conditional Use Permit by resolution.
