R-94-823• CITY OF CLERMON7' , RESOLUTION No. 823 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CLERMONT, LAKE COUNTY, FLORIDA GRANTING A CONDITIONAL USE PERMIT TO AMEND RESOLUTION NO. 716 TO ADD ADDITIONAL PROPERTY TO THE LEGAL DESCRIPTION, TO ALLOW THE OPERATION OF A RESTAURANT AND TO ALLOW A TEMPORARY RESIDENTIAL USE LOCATED IN THE C-1 LIGHT COMMERCIAL DISTRICT. WHEREAS, the Planning and Zoning Commission of the City of Clermont, Lake County, Florida at a meeting held June 7, 1994 recommended approval of this Conditional Use Permit to amend Resolution No. 716 to add additional property to the legal description, to allow the operation of a restaurant and to allow a temporary residential use located in the C-1 Light Commercial District at the following location: LEGAL DESCRIPTION Beginning at the southwest corner of West Avenue and Osceola Street thence extending north 60' to the northwest corner of Osceola Street and West Avenue, thence extending west 258' to the border of West Lake, thence southeastwardly along said border of West Lake 67' to the south side of Osceola Street, thence • east along Osceola Street 228 feet to the point of beginning. Also Beginning at the northeast corner of said Block 94, thence south along the west line of West Avenue 50', thence west parallel to the north line of said Block 94 a distance of 150', thence north parallel to the west line of West Avenue 50' to the north line of said Block 94, thence east along the north line of said Block 94 a distance of 150' to the point of beginning and lot 2, Block 94. The City Council deems it advisable in the interest of the general welfare of the City of Clermont, Lake County, Florida to grant this Conditional Use Permit; NOW THEREFORE BE IT RESOLVED by the City Council of the City of Clermont, Lake County, Florida that: SECTION 1. This application for a Conditional Use Permit to amend Resolution No. 716 to add additional property to the legal description, to allow the operation of a restaurant and to allow a temporary residential use located in the C-1 Light Commercial District be granted subject to the following conditions: • 1 • CITY OF CLERMONT • RESOLUTION • No. 823 1. Approval of the proposed use shall be conditioned upon compliance with all previous conditions specified in Resolutions 671 and 716, respectively. 2. The conditions as set forth in this Conditional Use Permit shall be legally binding upon any heirs, assigns and/or successors in title or interest. 3. The condition #7 as specified in CUP No. 671 shall be modified to include that "wooden gates" shall be utilized with the required masonry dumpster enclosure. 4. The permittee shall be allowed temporary residential utilization of the former railroad depot for a period of eighteen (18) months from the formal date of grant by the City Council. All applicable regulations of Lake County and SBCCI building standards shall be adhered to in accommodation of the temporary residential use. No commercial utilization of the site shall be permitted until such time as the temporary residential use vacates the subject site.
