RESOLUTION
No. 816
A RESOLUTION OF THE CITY OF CLERMONT, LAKE COUNTY,
FLORIDA, TO ASSUME OWNERSHIP OF A FLORIDA DEPARTMENT
OF TRANSPORTATION WATER RETENTION AREA.
WHEREAS, the City Council of the City of Clermont, Lake County, Florida,
has proposed improvements for Bloxam Avenue and is obligated to provide retention
for the runoff generated from said project; and
WHEREAS, it would be beneficial and cost conducive for the City of Clermont
to assume ownership of a drainage retention area described in Exhibit "A" attached
hereto; and
WHEREAS, the State of Florida, Department of Transportation has agreed to
• convey, by Quit Claim Deed, to the City of Clermont said retention area, retaining to
the Department of Transportation existing drainage rights to the water retention area;
and
WHEREAS, the City of Clermont will assume maintenance responsibilities for
said retention area; and
WHEREAS, the City of Clermont will assume permitting rights for said
drainage retention area; and
WHEREAS, the City of Clermont shall indemnify the State of Florida,
Department of Transportation for all damages and expenses from which the
Department of Transportation may become liable as the result of any alleged act of
neglect on the part of the City of Clermont in maintaining the hereinabove described
drainage retention area; and
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF CLERMONT, FLORIDA:
Section 1. The City of Clermont shall obtain from the State of Florida, Department
of Transportation the drainage retention area described in Exhibit "A" and attached
hereto subject to existing drainage rights.

Section 2. The City of Clermont shall be responsible for maintenance of said drainage
retention area.
Section 3. The City of Clermont shall assume permitting rights for said retention
area.
Section 4. The City of Clermont shall indemnify the State of Florida, Department of
Transportation for all damages and expenses for which the Department of
Transportation may become liable as a result of any alleged act of negligence of the
City of Clermont in maintaining said drainage retention area.
i n This Resolution shall take effect on the date of transfer of ownership of
• said retention area.
