R-98-1004• • • CITY OF CLERMONT RESOLUTION No. 1004 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CLERMONT, LAKE COUNTY, FLORIDA GRANTING A CONDITIONAL USE PERMIT TO ALLOW THE OPERATION OF A DAYCARE, LOCATED IN THE R-3-A RESIDENTIAIJ PROFESSIONAL DISTRICT. WHEREAS, the Planning and Zoning Commission of the City of Clermont, Lake County, Florida at a meeting held May 5, 1998 recommended approval of this Conditional Use Permit to allow the operation of a daycare, located in the R-3-A ResidentiaVProfessional District at the following location: LOCATION 1001 East Avenue The City Council deems it advisable in the interest of the general welfaze of the City of Clermont, Lake County, Florida to grant this Conditional Use Permit; • NOW THEREFORE BE TT RESOLVED by the City Council of the City of Clermont, Lake County, Florida that: SECTION 1. This application for a Conditional Use Permit to allow the operation of a daycare, located in the R-3-A ResidentiaVProfessional District be granted subject to the following conditions: 1. The conditions as set forth in this Conditional Use Permit shall be legally binding upon any heirs, assigns and/or successors in title or interest. 2. No change of the use or additions to the use shall be permitted except as approved by another Conditional Use Permit. 3. The property shall be developed in substantial accordance with an approved site plan incorporating all conditions of this Conditional Use Permit. Said plans shall be submitted for review and approval of the Site Review Committee prior to authorization and issuance of a development permit. 4. All applicable rules and regulations shall be met, including but not limited to final site plan approval, landscaping, drainage, pazking and sign regulations, and all yazd setbacks. All required landscaping must be served with a permanent irrigation system including City approved back-flow prevention device and rain sensor gauge (automatic irrigation system requirement only). All of the requirements of other regulatory agencies and public safety entities concerning day care and pre-school facilities shall be met. All required improvements must be completed prior to issuance of a certificate of occupancy for the requested 6. Buffering and screening shall be required from all abutting uses in accordance with adopted City Codes and in conformance with the approved site and landscaping plan approved by the City Site Review Committee prior to arty business activity on the site. 7. All required site improvements shall be constructed prior to a Certificate of Occupancy or Occupational Licence being issued for the proposed business. If occupancy or business activity occurs prior to improvements being provide this Conditional Use Permit shall become null and void. 8. If, at a future date, parking at this site proves inadequate the applicant understands and agrees that the City may require additional parking or rescind this Conditional Use Permit. 9. The permit shall become null and void (expire) if a Certificate of Occupancy and Occupational • Licence have not been issued for the proposed site and use within six months (6) from the formal date of grant of this Conditional Use Permit. 10. If any of the stated conditions are violated, the applicant understands and agrees that the City Council may revoke this Conditional Use Permit by resolution. DONE AND RESOLVED BY THE CITY COUNCII.
