R-98-0991r • • CITY OF CLF,RMONT RESOLUTION No.991 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CLERMONT, LAKE COUNTY, FLORIDA GRANTING A CONDITIONAL USE PERMIT TO ALLOW THE OPERATION OF A COMBINATION RETAIL BUSINESS AND COFFEE SHOP (RESTAURANT) IN THE CBD CENTRAL BUSINESS DISTRICT. WHEREAS, the Planning and Zoning Commission of the City of Clermont, Lake County, Florida at a meeting held February 3, 1998 recommended approval of this Conditional Use Permit to allow the operation of a combination retail business and coffee shop (restaurant) in the CBD Central Business District at the following location: LOCATION 719 West Avenue The City Council deems it advisable in the interest of the general welfare of the City of Clermont, Lake County, Florida to grant this Conditional Use Permit; • NOW THEREFORE BE IT RESOLVED by the City Council of the City of Clermont, Lake County, Florida that: SECTION 1. This application for a Conditional Use Permit to allow the operation of a combination retail business and coffee shop (restaurant) in the CBD Central Business District be granted subject to the following conditions: The conditions as set forth in this Conditional Use Permit shall be legally binding upon any heirs, assigns and/or successors in title or interest. 2. The Permittee shall provide the required number of parking spaces for portions of the facility utilized for restaurant "patron" oriented purposes through any of the following means as follows: a. Provision of required parking spaces on-site. b. Lease agreement with a property owner within the Central Business District. c. Payment into the Parking Space Exchange Fee Program. 3. Required parking for the proposed Coffee Shop (restaurant) use shall be provided prior to operation of that portion of the business. i • • CITY OF CLERMONT RESOLUTION No. 991 Page-2- • 4. The structure shall be inspected by all applicable Fire, Public Health, and Food Services agencies responsible for operation of such a business, and all requirements of applicable agencies shall be met prior to that portion of the business being conducted. All applicable agency licenses must be secured prior to operation of the business. 5. No further expansion of the use or additions to the facility shall be permitted except as approved by another Conditional Use Permit. 6. The final Certificate of Occupancy shall not be issued until each of the stated conditions has been met. 7. If any of the stated conditions are violated, the applicant understands and agees the City Council may revoke this Conditional Use Permit by Resolution.
