O-360-CCITY OF CLERMONT ORDINANCE N0.360-C AN ORDINANCE OF THE CODE OF ORDINANCES OF THE CITY OF CLERMONT, LAKE COUNTY, FLORIDA, AMENDING THE CODE OF ORDINANCES, CHAPTER 90 CONCURRENCY MANAGEMENT, ARTICLE 1. IN GENERAL, SECTION 90-6. ADOPTED LEVEL OF SERVICE STANDARDS; SECTION 90-7. ESTIMATION OF DEMAND FOR PROPOSED DEVELOPMENT; PROVIDING FOR SEVERABILITY; PROVIDING FOR AN EFFECTIVE DATE, AND PROVIDING FOR PUBLICATION. WHEREAS, pursuant to the provisions of Chapter 163, Florida Statutes, the City of Clermont Planning and Zoning Commission, acting as the Local Planning Agency of the City, has held a public hearing on July 1, 2008 and following such hearing found this Ordinance to be in the best interests of the City of Clermont, and recommended that the City Council adopt this Ordinance; and WHEREAS, the City Council of the City of Clermont desires to amend Chapter 90 Concurrency Management, Article 1 In General, Section 90-6 Adopted level of service standards; Section 90-7. Estimation of demand for proposed development, of the City of Clermont's Code of Ordinances; and NOW, THEREFORE, be it enacted by the City Council of the City of Clermont, Florida as follows: SECTION 1. The City Council of the City of Clermont has the authority to adopt this Ordinance pursuant to Article VIII of the Constitution of the State of Florida and Chapter 163 and 166, Florida Statutes. SECTION 2. The City of Clermont Code of Ordinances is hereby amended to read as follows: Sec. 90-6. Adopted level of service standards. (a) The adopted level of service standards for those public facilities for which concurrency is required shall be as established in the city's comprehensive plan, and as follows: (1) Roads/traffic circulation. The standards for roads/traffic circulation are as follows: a. Principal arterials: U.S. 27 (a.k.a. S.R. 25) -Level of service C. This is a SIS facility and is mandated by the State Department of Transportation as a LOS "C". Level of 1 CITY OF CLERMONT ORDINANCE N0.360-C service C represents stable conditions. However, ability to maneuver and change lanes in mid-block locations maybe more restricted than in level of service B, and longer queues or adverse travel speeds of about 50 percent of the average free flow speed for the arterial class exist. Motorists will experience an appreciable tension while driving. State Road 50 (a.k.a. Highway 50) -Level of Service D. Level of service D borders on a range in which small increases in flow may cause substantial increases in approach delay and, hence, decreases in arterial speed. This may be due to adverse signal progression, inappropriate signal timing, high volumes, or some combination of these. Average travel speeds are about 40 percent of free flow speed. b. Minor arterials: Level of service D, as stated in subsection (1) a. of this section. c. Local collectors: Level of service D, as stated in subsection (1) a. of this section. d. The FSUTMS (Florida Standard Urban Transportation Modeling System) and the standard state department of transportation methods for evaluation of level of service and capacity shall be used, subject to modifications based on travel speed studies. (2) Sanitary sewer. The standard for sanitary sewer is 77.5 gallons per capita, per day. (3) Solid waste. The standard for solid waste is collection of up to 6.63 pounds per capita, per day. (4) Stormwater drainage. The standard for stormwater drainage is the ten-year, two- hour storm event (pre- and post-development discharge volume design at 50-year, 24- hour storm event; Florida Administrative Code Rule 40C-42 for OFW waters; and Florida Administrative Code Rules 40C-4 and 40C-40 for closed basins, where applicable). (5) Potable water. The standard for potable water is 220 gallons per capita, per day. (6) Recreation/open space. The standards for recreation/open space are as follows: TABLE INSET: Facility Standard Parkland/open space 10 acres per 1,000 persons Recreation and open space facilities: Picnic table 20 per 4,000 persons 2 CITY OF CLERMONT ORDINANCE N0.360-C Baseball/softball field 1 per 2,000 persons Tennis court 1 per 1,400 persons Basketball court 1 per 3,600 persons Volleyball court 1 per 6,000 persons Racquetball court 1 per 6,000 persons Recreational building 1 per 15,000 persons Shooting range 1 per 50,000 persons Golf course 1 per 25,000 persons Equipped play area 1 per 3,000 persons Football/soccer field 1 per 7,000 persons Multi-use court 1 per 10,000 persons Shuffleboard 1 per 1,000 persons Multi-sport playfield 1 per 5,000 persons (b) Notwithstanding subsection (a) of this section, the prescribed levels of service may be degraded during construction of new facilities, if upon completion of the new facilities the prescribed level of service will be met. Sec. 90-7. Estimation of demand for proposed development. (a) Roads/traffic circulation. (1) Traffic analysis required. All new developments shall be required to submit a traffic analysis in accordance with the Lake-Sumter Metropolitan Planning Organization's (MPO) Transportation Concurrency Management System (TCMS) and the Traffic Impact Study Methodology Guidelines Volume 1: Lake County Checkbook TCMS, dated May 28, 2008 and as amended. The Transportation Impact Study (TIS) is composed of three levels: • Tier 1 TIS: 0-25 Net New Peak-Hour Trips • Tier 2 TIS: 26-100 Net New Peak-Hour Trips • Tier 3 TIS: 101+ Net New Peak-Hour Trips This study shall identify the development's impact on the city's transportation system. The city may also require the submission of a traffic analysis for developments whose site location, anticipated total trip generation, circulation patterns or other such factors warrant a more extensive review of traffic impacts. 3 CITY OF CLERMONT ORDINANCE N0.360-C Upon results of the TIS, an applicant may be required to participate in the requirements of ARTICLE IL TRANSPORTATION PROPORTIONATE FAIR SHARE. Possible payment into an escrow account for transportation proportionate fair share impact (TPFS) for impacted roadways will be in accordance with the approved methodology of the TPFS formula, as amended. SECTION 3: Should any section or part of this section be declared invalid by any court of competent jurisdiction, such adjudications shall not apply to or affect any other provision of this Ordinance, except to the extent that the entire section or part of the section may be inseparable in meaning and effect from the section to which such holding shall apply.
