R-96-904• • • CITY OF CLF,RMONT' RESOLUTION No. 904 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CLERMONT, LAKE COUNTY, FLORIDA GRANTING A CONDITIONAL USE PERMTf TO ALLOW THE OPERATION OF A RETAIL STORE, PROFESSIONAL OFFICE AND COFFEE SHOP (RESTAURANT) IN THE CENTRAL BUSINESS DISTRICT (CBD). WHEREAS, the Planning and Zoning Commission of the City of Clermont, Lake County, Florida at a meeting held April 2, 1996 recommended approval of this Conditional Use Permit to allow the operation of a retail store, professional office and coffee shop (restaurant) in the Central Business District (CBD) at the following location: LOCATION 639 Eighth Street The City Council deems it advisable in the interest of the general welfare of the City of Clermont, Lake County, Florida to grant this Conditional Use Permit; NOW THEREFORE BE IT RESOLVED by the City Council of the City of Clermont, Lake County, Florida that: SECTION 1. This application for a Conditional Use Permit to allow the operation of a retail store, professional office and coffee shop (restaurant) located in the Central Business District (CBD) be granted subject to the following conditions: 1. The conditions as set forth in this Conditional Use Permit shall be legally binding upon any heirs, assigns and/or successors in title or interest. 2. The Permittee shall provide three (3) parking spaces through one of the following means: 1) Payment into the Parking Space Exchange Fee to be made in three increments, 1/3 due at time of issuance of the certificate of occupancy, 1/3 due twelve (12) months from the date of issuance of the certificate of occupancy, and 1/3 due twenty-four (24) months from the date of issuance of the certificate of occupancy; or 2) Provide a copy of a lease agreement with a property owner within the Central Business District for the leasing of three parking spaces; or 3) Provide three (3) parking spaces on site. • L~ • I~ U CITY OF CLF.RMONT RESOLUTION No. 904 Page-2- 3. The structures shall be inspected by the Fire Marshall for life safety requirements, all requirements must be met prior to any certificate of occupancy being issued. 4. The structures shall be inspected by the Department of Environmental Health and other applicable agencies for operation of a restaurant. All requirements of applicable agencies must be met prior to that portion of the business being conducted. 5. No further expansion of the use or additions to the facility shall be permitted except as approved by another Conditional Use Permit. 6. The final Certificate of Occupancy shall not be issued until each of the stated conditions has been met. 7. If any of the stated conditions are violated, the applicant understands and agrees the City Council may revoke this Conditional Use Permit by Resolution. • DONE AND RESOLVED BY THE CITY COUNCIL OF THE CITY OF CLERMONT, LAKE COUNTY, FLORIDA THIS 23RD DAY OF APRIL, 1996.
