R-95-871 . . . 8 8 CJ1Y OF CLERMONT RESOLUTION No. 871 A RESOLUTION OF THE CI1Y COUNCIL OF THE CI1Y OF CLERMONT, LAKE COUN1Y, FLORIDA GRANTING A CONDITIONAL USE PERMIT TO AMEND RESOLUTION NO. 847 TO REVISE THE LEGAL DESCRIPTION, TO ALLOW mE TEMPORARY OPERATION OF A BANK FACILI1Y IN AN EXISTING BUILDING AND TO TEMPORARILY ALLOW MULCH PARKING, LOCATED IN THE R-3-A RESIDENTIALIPROFESSIONAL DISTRICT. WHEREAS, the Planning and Zoning Commission of the City of Clermont, Lake County, Florida at a meeting held September 5, 1995 recommended approval of this Conditional Use Permit to amend Resolution No. 847 to revise the legal description, to allow the temporary operation of a bank facility in an existing building and to temporarily allow mulch parking, in the R-3-A ResidentiallProfessional District at the following location: LEGAL DESCRIPTION Lots 1, 2, 3, 4 and 5, Lakeview Heights Subdivision The City Council deems it advisable in the interest of the general welfare of the City of Clermont, Lake County, Florida to grant this Conditional Use Permit; NOW THEREFORE BE IT RESOLVED by the City Council of the City of Clermont, Lake County, FIOfida that: This ijppli~atiopfor a Conqitiønal TJ.se Permit to amend Resolution No. 847 to revise the legald.escpiption,.to allow the temporary operation of a bank facility in an existing building and tø ,teJl1porarily allow ll1ulch parking, located in the R-3-A ResidentiallProfessional 'Qistrictbe granted subject to the following conditions: 1. ThisConditio~al U.s~ permit shall be ~ppro:vedcønditioned upon compliance with all previous, conditions speçifi~qin Resolutio~ No. 814 and No. 847 with the exception of time framesÆorcønstruc.ÍÏOrl;.as' qelineated in this Conditional Use Permit. 2. The bank facility shall ;be-.permitted, one (1) freestanding or one (1) wall sign in conformance with'signregu)ations~pecifiéd for the ,R-3-A zoning district. 3. The permanent bank facility shall secure all necessary permits and commence "Substantial Construction Work" within nine (9) months from the date of grant by the City Council. "Substantial construction work" means the commencement and continuous prosecution of construction of required improvements ultimately finalized at completion. . . . " 8 G1Y OF CLERMONT RESOLUTION No. 871 Page - 2 - 4. This Conditional Use Permit shall expire eighteen (18) months from the date of formal grant by the City Council. 5. The temporary bank facility shall commence operation within six (6) months from the formal date of grant by the City Council otherwise this Conditional Use Permit shall become null and void. 6. If it is determined that the mulch parking has become problematic or is not properly maintained in accordance with City Code the Conditional Use Permit will be brought before the City Council for formal action. 7. The structure shall be inspected by the County Building Official and all building standards for use as a temporary bank facility shall be provided prior to a certificate of occupan~ being issued. 8. The structure shall be inspected by the Fire Marshall for life safety requirements and all standards for use as a temporary bank facility shall be provided prior to a certificate of occupancy being issued. 9. If in the future, the g~nerationof refuse and trash exceeds normal residential container amounts a dumpster with standard required enclosure shall be installed. 10. All lighting for the proposed facility shall be designed and located such that light and/or glare shall be directed \lpon the subject property only. 11. The final. certificate ofoçcupançy for the temporary bank facility shall not be issued until each of the stated conditions have been met. 12. If any of the staled conditions .are violated, the applicant understands and agrees the City Council may revoke this Conditional Use Permit by Resolution.
