2009-03FIRST AMENDMENT TO WATER AND
WASTEWATER SERVICE AGREEMENT BETWEEN
THE CITY OF CLERMONT AND BAILES HOLDING LLP
This Addendum is to that certain agreement of May 16, 2006 (the Agreement) between the
CITY OF CLERMONT, FLORIDA, hereinafter referred to as "CITY" and BAILES HOLDING
LLP, and hereinafter referred to as "OWNER". The parties, in exchange for the mutual covenants
contained herein and in the Agreement, agree as follows:
1. This Amendment expressly modifies the Agreement and in the event of a conflict,
the terms and conditions of this Amendment shall prevail.
2. In accordance with Section 1 of the Agreement, the parties agree that OWNER shall
oversize the water and wastewater lines to be installed by the OWNER for the benefit of CITY's
nvironmer~tal utilities system. 'The oversizing shah be in accordance with the construction costs
and estimates attached hereto and incorporated herein as Exhibit "A" and all approved plans.
3. CITY agrees to pay to OWNER within thirty (30) days of the acceptance of the
completed construction or the date of execution of this Amendment by both parties, whichever is
later, the sum of $11,220.03 for the oversizing.
3. All other terms and conditions set forth in the Agreement shall remain in full force
and effect and unchanged as agreed to by the parties.
IN WITNESS WHEREOF, the parties hereto have made and executed this Addendum for
the purposes herein expressed on the dates set forth below.
